Terms of Service

1. Acceptance of Terms

By accessing or using MasReach ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including businesses and individuals who access the Service.

We reserve the right to update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

2. Description of Service

MasReach is a multi-platform advertising management platform that allows users to create, manage, and monitor ad campaigns across Google Ads, Meta (Facebook/Instagram), and other advertising platforms from a single interface. The Service includes:

  • Campaign creation and management across connected ad platforms
  • Budget allocation and targeting configuration
  • Campaign performance monitoring and metrics
  • OAuth-based integration with third-party ad platforms
  • Ad creative asset management
  • A booking page for lead capture, including SMS and email notifications

3. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or the business you represent. By using MasReach, you represent and warrant that you meet these requirements.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

  • Provide accurate, current, and complete information when registering
  • Keep your login credentials secure and not share them with others
  • Notify us immediately of any unauthorized use of your account
  • Not create multiple accounts to circumvent restrictions or bans

5. Authorized Use

When you connect an ad platform account to MasReach, you authorize us to:

  • Read your campaign data, budgets, and performance metrics from connected platforms
  • Create and update campaigns on those platforms when you initiate those actions
  • Store OAuth tokens necessary to maintain the connection

You are solely responsible for ensuring you have the right to connect and manage the ad accounts you link to MasReach. Do not connect accounts you do not own or have explicit authorization to manage.

6. SMS & Text Message Communications

MasReach operates an Application-to-Person (A2P) SMS messaging system that sends text messages on behalf of businesses using the platform. By submitting a booking request through a MasReach-powered booking page, you expressly consent to receive SMS messages from the applicable business, delivered via MasReach's messaging infrastructure.

Types of Messages Sent

  • Booking confirmation messages sent to customers who submit an enquiry form
  • Lead alert notifications sent to business owners when a new booking is received
  • Follow-up or appointment reminder messages, where applicable

Opt-In & Consent

SMS consent is obtained at the point of form submission via the booking page. The consent language displayed to users is: "By submitting this form you agree to receive SMS and email messages from [Business Name] regarding your enquiry. Message and data rates may apply. Reply STOP to unsubscribe." Consent is not a condition of any purchase or service.

Message Frequency

Message frequency varies based on booking activity. Recipients typically receive 1–2 messages per booking enquiry (a confirmation and any follow-up). Business owners receive one alert per new booking received.

Message & Data Rates

Message and data rates may apply depending on your mobile carrier plan. MasReach does not charge recipients for SMS messages; however, your carrier's standard rates may apply.

Opt-Out (STOP)

You may opt out of SMS messages at any time by replying STOP to any message you receive. Upon receipt of a STOP request, we will cease sending SMS messages to that number. You may also contact us at masreachadmin@masreach.net to request removal.

TCPA Compliance

MasReach's SMS messaging operates in compliance with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and applicable carrier guidelines including CTIA Messaging Principles and 10DLC (A2P) registration requirements. We do not send unsolicited marketing messages. Phone numbers collected through booking forms are never sold or shared with third parties for marketing purposes.

Business Owner Responsibilities

If you are a business using MasReach's booking page, you are responsible for ensuring your use of SMS notifications complies with applicable law. You must not use MasReach's messaging features to send unsolicited or deceptive messages, and you must honor all opt-out requests promptly.

7. Prohibited Uses

You agree not to use MasReach to:

  • Violate any applicable law, regulation, or the terms of service of connected ad platforms
  • Create or promote illegal, deceptive, or misleading advertising
  • Connect ad accounts you are not authorized to manage
  • Attempt to reverse engineer, hack, or circumvent any security measures
  • Use automated scripts or bots to interact with the Service beyond its intended use
  • Interfere with or disrupt the integrity or performance of the Service
  • Upload malicious content, viruses, or harmful code
  • Use the Service to spam, phish, or engage in fraudulent activity
  • Send unsolicited SMS messages or violate TCPA or carrier messaging guidelines
  • Use SMS features to contact individuals who have opted out or not consented

8. Intellectual Property

The MasReach platform, including its design, code, branding, and content, is owned by MasReach and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our platform without our express written permission.

You retain full ownership of any campaign data, ad creatives, and content you upload to MasReach. By uploading content, you grant us a limited license to store and process it solely for the purpose of providing the Service.

9. Website Assets & Creative Generation

As part of the campaign setup process, MasReach may access your publicly available website to collect images, copy, and other creative assets for use in building your ad campaigns. By providing your website URL and using this feature, you represent and warrant that:

  • You own or have the legal right to use all images, text, logos, and other content published on the website URL you provide.
  • You have the authority to grant MasReach permission to access, download, and store those assets for the purpose of creating ad creatives on your behalf.
  • No assets on your website infringe on the intellectual property rights of any third party.

Assets retrieved from your website are stored securely in a dedicated folder within your MasReach account. They are used solely to generate ad creatives for your campaigns and are not shared with other clients or used for any other purpose.

MasReach is not responsible for any third-party intellectual property claims arising from assets you provide or that are publicly available on your website. You agree to indemnify MasReach against any such claims.

10. Payment & Billing

MasReach may offer paid plans. If you subscribe to a paid plan, you agree to pay all applicable fees. Subscription fees are billed in advance and are non-refundable except where required by law. We reserve the right to change pricing with 30 days' notice.

MasReach does not handle your ad spend — all advertising budgets are billed directly by the respective ad platforms (Google, Meta, etc.) under your own accounts.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any defects will be corrected.

We are not responsible for the availability, accuracy, or performance of third-party ad platforms. Campaign results and advertising performance are not guaranteed.

12. Limitation of Liability

To the maximum extent permitted by law, MasReach and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost ad spend, or data loss — arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from use of the Service shall not exceed the amount you paid to MasReach in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless MasReach and its team from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.

14. Termination

You may cancel your account at any time by contacting us. We reserve the right to suspend or terminate your account at our discretion if you violate these Terms or engage in conduct we deem harmful to the Service or other users.

Upon termination, your access to the Service will cease and your data will be deleted in accordance with our Privacy Policy.

15. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law. You waive any right to participate in a class-action lawsuit against MasReach.
